1. General Remarks
1.1 The terms and conditions set out below are the only terms and conditions valid for all orders placed via the website shop.gonvienna.com, and for all resulting shipments. The relevant terms and conditions are always those in effect at the time the order was placed. Any differing rules will not be respected, unless GON e.U. explicitly agrees to them in writing. 
1.2 The products sold via shop.gonvienna.com are depicted on the homepage shop.gonvienna.com in the form of digital photographies of the actual products. Small deviations between the product and its photography do not imply a fault of the product. 
 
1.3 The information on the availability of the products as given on the website is constantly updated and normally coincides with the actual availability of the products. In exceptional cases it can occur that a product is already out of stock at the time an order is placed. In this case, we will inform the customer via E-Mail the next working day at the latest. 
 
1.4. The online-shop shop.gonvienna.com may make partial deliveries. 
 
 
2. Contract
2.1 An order via the website shop.gonvienna.com is an offer, not a contract. A contract between the customer and GON e.U. only is established once we accept the offer, or at the latest when we send the product. By filling out and sending the form on shop.gonvienna.com, the customer makes a binding offer to enter into a contract with us. This binding offer consists in completing the form and clicking "Confirm Order". 
 
2.2 After receiving the order, GON e.U. will inform the costumer via E-Mail about the receipt of the order; for this, the E-Mail address the customer indicated in the order form will be used. This notification contains all customer and order details, and can be printed out. This automatic order confirmation only documents the receipt of the order, and does not represent an acceptance of the offer, or a binding contract. 
 
2.3 GON e.U. has the right to refuse any offer without stating reasons, especially if there is reason to believe that any products purchased via shop.govienna.com will be sold commercially. 
 
2.4 By pressing the "Confirm Order" button, the customer automatically saves the details of the order; these details can be viewed on the webpage using the registration the customer created when placing the order. 
 
 
3. Instructions on the Cancellation of an Order
3.1 The right to cancel: The customer has the right to cancel an order in writing (letter or E-Mail) within 14 days after placing the order without having to state any reasons or simply by returning the purchased items within 14 days.
This 14 day period starts when the following two conditions are met: the customer has received this information about his or her right to cancel an order as stated in these terms and conditions, and the product has been received by the customer.

3.2 Consequences of a cancellation: In the case of a valid cancellation, all received payments have to be returned and any interest on these payments has to be reimbursed. If the customer has enjoyed any advantages from the product, and is therefore not able to return it to us, or only in a worn condition, the customer has to reimburse us for any fall in the value of the product. The customer has to reimburse us only for falls in value that are consequences of a use of the product that exceed a normal testing of the quality and the functioning of the product. "Normal testing of the quality and the functioning of the product" means the testing and trying out of a product as it is customary in a shop. Items that are shipped in a package are sent at our risk and at our expense. Items that cannot be shipped in a package will be picked up from the customer. Any obligations for payments have to be fulfilled within 30 days. For the customer, this period starts with the cancellation of an order or the return of the product; for us, this period starts after receiving the product. 
 
 
4. Delivery and Shipping
4.1 We ship all products off the shelf to the address given to us by the customer. Unless otherwise explicitly agreed, products cannot be picked up. 
 
4.2 GON e.U. advises the customer, that all and any information on availability of the product, shipment and receipt are guidelines only. They do not constitute binding shipment or delivery dates. 
 
4.3. We deliver to countries that are liable for customs duty within five to twelve working days. We cannot influence any delays that are caused by the customs authorities of these countries. The customer is liable for any additional value added taxes for imported products, customs or handling fees. Any inquiries concerning these customs and fees should be directed at the local customs authorities. 
 
 
5. Payment
5.1 Payments can be made in advance or via Paypal. If payments are made in advance, the product is only reserved for the customer. As soon as the payment reaches our account, we will ship the product to the customer. 
 
 
6. Prices and Shipping Fees
6.1. The stated prices on shop.gonvienna.com are tax-exempted since shop.gonvienna.com is a 'small business' as defined in §6 UStG. The stated prices are not inclusive of delivery- and shipping fees. Delivery and shipping fees are stated separately on the website shop.gonvienna.com. 
 
6.2. In the case of shipments to a country outside the European Economic Area (EEA), the customer is liable for all import and export fees, any customs or tariffs and any other fees. 
 
 
7. Retention of Title
7.1. Until all payments have reached GON e.U., any delivered items remain the property of GON e.U. 
 
 
8. Defects Liability
8.1 All products ordered via shop.gonvienna.com are subject to the statutory defects liability regulations. 
 
8.2. Should a product free of defects be delivered to the customer to replace a faulty product, GON e.U. has the right to demand the faulty product be returned. In this case, the customer has to return the product within 30 days. The return has to be in accordance with the statutory regulations. GON e. U. can ask for damages in accordance with the statutory regulations. 
 
 
9. Returns Policy
9.1. Any products ordered via shop.gonvienna.com can be returned within 14 days upon the receipt of the product by sending the product back to us. This 14 day period starts with the day the customer receives the product and the valid instructions for returns. To secure the returns period, it is sufficient to return the product in a timely manner. The customer bears the cost and the risk of the return. Reduced merchandise is exempt from this returns policy. 
 
9.2. The returned merchandise must reach us in an unused and unworn condition, fit for resale, in their original packaging with all their labels on. Damaged, soiled or used merchandise cannot be accepted. It is not allowed to use the merchandise commercially in any way before returning it. 
 
9.3. If the merchandise has lost value upon being returned to us, we can ask for a reimbursement for the lost value. The customer is liable only for falls in value that are consequences of a use of the product that exceed a normal testing of the quality and the functioning of the product. "Normal testing of the quality and the functioning of the product" means the testing and trying out of a product as it is customary in a shop. To avoid having to reimburse us for a fall in value, the merchandise should not be treated like the customer's own property, and any activities that can diminish the value of the product should be avoided. Any obligations for payments have to be fulfilled within 30 days. For the customer, this period starts with the cancellation of an order or the return of the product; for us, this period starts after receiving the product.

10. Privacy Policy
10.1 Customer data is only saved and processed by GON e.U. in accordance with the relevant statutory regulations. Personal information is only asked, stored and used to process an order. 
 
10.2 The customer can visit the website shop.gonvienna.com without having to share personal data. When accessing this site, data concerning the use of and the communication with the site are generated automatically to facilitate the access of the relevant content. These data are stored without a concrete connection to the person accessing the site, to acquire statistical information to improve the website and to assist trouble-shooting, as well as for research and analysis purposes. As soon as the customer places an order or contacts us via the contact form on shop.gonvienna.com, we acquire personal data. Only the fields marked as "required" have to be completed. 
 
10.3. GON e.U. does not pass on personal data to third parties. Exempt from this policy are contracting partners we use for the fulfillment of shipping and delivery. We only pass on data to contracting partners that are indispensable for them to complete their duties. 
 
 
10.4 The customer can explicitly agree to subscribe to our newsletter at shop.gonvienna.com. The customer can at any time cancel this newsletter and other advertising via E-Mail. 
 
 
11. Choice of law, effectiveness
11.1. The agreement shall be governed by and construed in accordance with Austrian law. Place of performance is Vienna, Austria. The courts of Vienna, Austria shall have jurisdiction. 
 
11.2 Should one or several regulations of these terms and conditions not be valid, this will not influence the effectiveness of the other regulations.
